I am from North Carolina. I received a speeding ticket for going more than 75 in South Carolina. Will my license be suspended?
If you have a N.C. Driver's License, the North Carolina D.M.V. has the authority to suspend your license if you receive a ticket for speeding more than 75 miles per hour. It is very important to do something about your ticket BEFORE your court date.
I already paid my ticket. Now I just found out that my North Carolina Driver's License has been suspended! Is there anything I can do now?
If you received a letter like this:
You need to do something about it NOW! Sometimes a speeding ticket can be "re-opened." But there are a lot of technical requirements involved in this process. Usually, only an attorney can help you with this process. It is very important that you contact an attorney immediately upon finding out that your license has been suspended. If you wait too long, it will become less likely that anything can be done to help you. Many times, the letter from the D.M.V. will tell you that your license is going to be suspended on a future date. Your best bet is to contact a North Carolina attorney and an attorney from the state where you received the ticket. The North Carolina lawyer can sometimes postpone the suspension, while the lawyer in the ticket-issuing state tries to re-open the ticket.
Can I get "Prayer for Judgment" for my ticket? Can I get "supervision" or "probation" for my ticket?
Not in South Carolina. Our state does not have "prayer for judgment," or any other procedure that will "suspend" the speeding charges, or "make them go away." Many other states have procedures that will make a speeding ticket "go away." North Carolina has a procedure called "Prayer for Judgment." Illinois, Georgia, Florida and New York all have various forms of "supervision" or "probation" which will allow a driver to dispose of a speeding ticket if the driver pays a "supervision" fee and then drives a certain period of time (for instance, 1 year) without getting another ticket. South Carolina has none of these procedures. Your insurance company will find out about your speeding ticket in South Carolina if you are convicted.

What are my rights in Traffic Court?
You have the same rights in a South Carolina Traffic Court that you have in a South Carolina Criminal Court. You have the right to a jury trial. You have the right to be represented by an attorney. Sometimes it is advantageous to be represented by an attorney in Traffic Court.

Speeding Tickets are usually $500.
A Motion to Re-Open is usually $1,500.
